Hayes Forest Services Limited, Hayes Holding Services Limited, and Hayes Helicopter Services Ltd. (collectively "Hayes")

Hayes obtained a Court Order from The Supreme Court of British Columbia on Thursday, July 31, 2008 pursuant to the Companies' Creditors Arrangement Act ("CCAA"). The Initial Court Order provided Hayes with a stay of proceedings against all actions and creditors.

At the Court hearing on September 28, 2009 the stay was extended to November 30, 2009 and the Court approved a Claims Process Order. The stay has subsequently been extended to March 31, 2010.

The Plan of Reorganization and other material will be sent to creditors in accordance with the Claims Process Order dated September 28, 2009 and the Meeting Order dated February 5, 2010.

The Plan offers Unsecured Creditors a total of $400,000 to be distributed pro rata in full settlement of their claims.

The meeting of creditors to consider the Plan will take place at 10 a.m. on March 17,2010 at Suite 2300, 550 Burrard Street, Vancouver, BC. The conduct of, and voting procedure at, that meeting is set out in the Court Order dated February 4, 2010.

In order to vote on the Plan, creditors must have filed or been deemed to have filed a Proof of Claim and must have filed a proxy with the Monitor by March 15, 2010. Creditors with proven claims not attending the meeting can vote by proxy.

The Monitor's report on the Plan is set out in the Seventeenth Report.
